All orders accepted by C.J. Anderson & Company (CJA) are subject to the following terms and conditions, regardless of price or terms and conditions shown on the buyer’s purchase order. C.J. Anderson & Companies acceptance of any purchase order is based upon the terms and conditions listed herein. Modifications or additions to these terms will not be recognized unless agreed to in writing by an authorized officer of CJA.

Only certified/licensed elevator mechanics and contractors in the state that they reside in should install or repair our equipment. Failure to have them install or repair your elevator may lead to death or injury. There are many live circuits, high voltage and equipment that will kill you in an instant.

QUOTATIONS

All quotations expire in 30 days unless extended in writing. All quotations have dates printed on them. Pricing on this website is subject to change without notice.

Minimum Order Amount

Orders under $25.00 will be charged an additional  handling fee. 

Prices

All prices are in accordance with CJA’s established selling price, and are subject to change without notice. Merchandise will be invoiced at prices prevailing at time of shipment for Net 30 open account customers. Orders placed on our website are credit card only and your card will be charged immediately upon checking out. Some items have extended lead times and may be noted on the items purchase page. While prices should include sales tax and shipping charges, other prices including excise or similar taxes,  duties, customs, or other types of fees may not be included and may be charged/invoiced at a later date. All prices are F.O.B. Harwood Heights, IL. All prices are in U.S. funds

Delivery

Every effort will be made to honor delivery dates; however, delivery dates are not guaranteed.

Shipping

Shipments will be made within a reasonable time after receipt of order.  In the event all merchandise ordered is not in stock, partial shipments will be made.  For Net 30 Open Account customers each shipment will be invoiced separately and payment is due as billed.  CJA will not be liable for any default or delay in shipment. CJA does not guarantee ship dates.

All shipments are FOB: Harwood Heights, IL - the buyer assumes responsibility for the goods once they have been shipped by the seller, meaning as soon as the goods are loaded onto the transport vehicle at the shipping point, (Harwood Heights, IL) . From that moment, the buyer is responsible for shipping costs, insurance, and risk of loss or damage to the goods during transit.

Shipments will be made Ground unless instructed otherwise.  Costs for freight charges, overnight delivery, insurance, fees and forwarding will be added to the invoice.  Overseas shipments are freight collect UPS International.

Products are packaged for UPS type of shipping. If crating of products is required there will be an additional charge.

Invoices not paid within payment terms will cause additional orders to be put on hold and not shipped until the terms are met.

Damaged Shipments

All shipments are FOB: Harwood Heights.  When given to the carrier, title of the merchandise transfers to the buyer.  If your product was damaged during shipping please indicate this in writing with the shipping carrier as well as photos. Also copy sales@cjanderson.com with this information. If the package is damaged to the extent the contents may have been lost in transit do not accept the shipment and refuse it.  Therefore, merchandise damaged in shipping is the buyer’s responsibility.  Buyer should thoroughly inspect all items for shipping damage before accepting delivery.  If damage has occurred, buyer should file a claim with the carrier as well as notify C.J. Anderson regarding the damage.

Order Cancellation

Orders may be canceled prior to shipping by written notification from the purchaser for items that are “stock-able”.  If cancelation is for a non-stock custom fabricated item, the purchaser will be charged for costs expended prior to receipt of cancelation. This includes drafting/engineering time involved with the project.

Return For Credit

Only CJA stock items and materials in active demand may be returned for credit.  Returns must be made within 90 Days from the date of purchase and must have prior authorization from CJA.  Returns must be properly packaged, shipped and freight prepaid and insured. Please contact CJA for a return authorization number or click on the following RMA Form link. Only company credits will be provided for use against open invoices and/or new orders. Check or credit card refunds will not be issued. Credits must be used within 365 days of the date they were issued after which they will be closed out automatically.

Restocking Charge

All authorized returns are subject to a twenty-five percent (25%) restocking fee.

Payment Terms

Terms of payment are net 30 days from the date of invoice for purchasers with approved credit.  Shipments to purchasers who have not established credit will be made cash in advance or credit card.  To establish credit, complete an Application for Open Account Form.  All payments must be in U.S. funds. Additional fees and charges apply for wire transfers, credit card payments and shipments. 

Past due accounts are subject to a service charge, not to exceed the Illinois legal limit.

The purchaser is liable for payment. CJA will not accept any agreements or terms that shift liability to a third party.

Technical Assistance

CJA staff personnel are available to answer any questions concerning the use or application of CJA products.  However, any field changes made to the products are the sole responsibility of the user, unless authorized by CJA in the form of revised wiring diagrams or technical bulletins. We provide technical assistance to licensed elevator contractors only.  We also are not installers meaning the knowledge and support are limited to our products and not specific job site conditions. 

Maintenance Of Products

All CJA products require scheduled periodic inspections, adjustments, lubrication and other routine maintenance actions.  Non-performance of maintenance will nullify the product warranty. Periodic elevator equipment maintenance schedules must be determined by the elevator mechanic/installer/contractor and should be based on the environment, the age of the equipment and the frequency the equipment is used.  Since C.J. Anderson & Company does not install or maintain elevator equipment we cannot determine this.  Lubricating pivot points on all devices and ensuring that where self wiping contacts making good contact and also that no part of the device is broken or worn so it does not function as intended. Under no circumstances should any safety device be defeated or bypassed.  Death or injury could occur.  Equipment that is not properly maintained can lead to injury and/or death.  Never leave a elevator running in an unsafe condition.  Always follow proper safety precautions as you were trained to do so you go home to your family each night.  

Limits of Liability

CJA’s entire liability and the purchaser’s exclusive remedy shall be as follows:

In all situations, including performance or non-performance of the material ordered, the purchaser’s remedy is that provided under the warranty provision.

CJA’s liability for loss of or damage to purchaser for any cause whatsoever and regardless of the form of action, contract or in tort, including negligence, shall be limited to the price of the part on which such liability is based. CJA will not be liable for any injury, special, direct or consequential damage, loss of time, profit or other losses, labor charges, repairs, expenses or other cost arising out of the incorrect use of, or the inability of the purchaser to use the product or the lack of maintenance performed on the elevator and or the devices within the system.  Correction of any defects by repair or replacement by CJA shall constitute fulfillment of all obligations to the purchaser.

In no event will CJA be responsible for any loss, damage or delay. In no event will CJA be liable for any damages caused by purchaser or for any lost profits or other special, incidental or consequential damages.

CJA products are only warranted to function as designed and manufactured. If the product does not meet the purchasers expectations or standards, the purchaser is still obligated to pay for the product in full.

Every order taken by CJA is subject to the terms and conditions listed above regardless of the purchasers terms and conditions. 

Warranty

All CJA products are warranted to the original purchaser to be free from defects in material and workmanship for a period of one year from the date of shipment, provided they are (1) paid for, (2) installed as designed and (3) used for the purpose intended (4) and maintained in accordance to the elevator installers/maintenance schedule.  This warranty will only be effective after notification from the purchaser of a product defect, return of the part freight prepaid, and after CJA inspection proves the part to be defective. CJA’s total obligation under this warranty is to repair or replace free of charge defective products.

If the product is determined to be out of warranty an estimate to repair will be sent to the purchaser.

Before using or furnishing to another for their use, the purchaser shall determine the suitability of the product for its intended use and purchaser assumes all risks and liabilities in connection therewith. Any unauthorized repairs or adjustments shall cancel this warranty and shall relieve the company from any further responsibility. 

This foregoing warranty is in lieu of all other warranties, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.
